The contract is for a short-term holiday rental of Abernethy, Keswick (“the property”) between the person booking and the members of his/her party (“the hirer”) and the owners of Abernethy (“the owners”), and is binding from such time that booking is made and inclusive of all the following conditions.
By making a booking the hirer contracts on behalf of himself/herself and all those in his/her party and represents that he/she has the authority to accept these conditions on behalf of and binding upon all members of his/her party.
Bookings are accepted on the understanding that the property is taken for holiday purposes only and that the number of people in the property is limited to that entered on the booking form. Maximum capacity is 12 people in 5 bedrooms.
The hirer and any friends or family or guest of the hirer visiting the property while the hirer is staying must adhere to these conditions.
The booking commences when the deposit and completed booking form have been received by the owner.
A deposit of 25% of the total rental cost is payable on booking if the booking is made more than 6 weeks before the start of the rental. The balance shall be payable 6 weeks before the commencement of the rental. Non-payment of the balance of the rent on or after the due date may be construed as a cancellation of the contract by the hirer.
In the event of the hirer cancelling the booking any payments made by the hirer to the owner would only be refundable if the property is let to another group for the period cancelled. If the property is let to another group the owner will refund payments less any costs/discount incurred in securing another reservation. If the property is not successfully let to another group no monies will be refunded. If this is a concern we recommend you take out a suitable insurance.
In the unlikely event that the owner cannot make the property available for whatever reason (including but not limited to: flood, fire, property damage, personal injury/incapacity, property services failure or other) the owner will repay all monies paid by the hirer to the owner for the booking of the property. The owner will not have any liability for any other loss or damage or cost of alternatives or disappointment arising from or relating to the cancellation. Under no circumstance will the owner pay more than the monies received from the hirer in connection with the booking.
Period of Hire
Rental of the property will commence after 4pm on the start date of your holiday and terminate at 11am on departure date. Under no circumstances may the Hirer enter the property before 4pm on the commencement date and the property must be vacated by 11am on the termination date.
Right of Entry
Whilst respecting the reasonable privacy of the hirer, the owners reserve the right to access the property at all times, if necessary, for repairs and emergencies.
Care of the Property
The owners endeavour to present the property to a high standard of housekeeping and repair so that the hirer can enjoy their stay. In renting this property the hirer agrees to look after the property and leave it in the condition in which they found it, and agree to leave the property tidy and to pay for any damage or extra cleaning they my cause.
The Hirer must not cause an annoyance or become a nuisance to occupants of the neighbouring properties. Abernethy is in a quiet residential area of Keswick . Anyone using the property must be respectful to the neighbours; accordingly a condition of using the property is that noise is not a disturbance in the late evening/early morning. Due to these restrictions the property is not to be used by stag or hen party groups.
Smoking is not permitted anywhere inside the property.
Pets are not permitted other than by prior agreement with the owner.
One well behaved dog would be permitted subject to prior arrangement with the owners and the following conditions.
The dog must not be permitted upstairs or on the furniture. Dogs must not be left unattended in the property at any time.
The hirer is responsible for any damage howsoever caused by their dog and liable to reimburse the owner for any replacement or repair thereby necessitated.
The owners are not liable for any loss or damage to any of the hirer’s property or any property belonging to a member of the hirer’s party howsoever caused.
The owner will not accept any liability and the hirer or members of his/her party will not hold the owners of the property liable for any personal injury/death or property loss/damage howsoever sustained.
The Owners shall not be liable for any loss of profit, consequential loss or other indirect losses under the terms of this Agreement.
The Owners take every care to ensure that the accuracy of property descriptions and information contained on the website are correct at the time of publication. However in the event of any error, the Owners accept no liability for any loss or inconvenience to the hirer. There are no warranties, conditions, guarantees or representations as to description, merchantability or fitness for a particular purpose or other warranties, conditions, guarantees or representations whether express implied by statute or otherwise oral or in writing except as provided herein or such as cannot be excluded by law.
The use of any amenities or household items, offered with the property, such as games, books, DVDs, toys, cots/high-chairs, household items/utensils/appliances, barbecue, is entirely at the user’s risk and no responsibility will be accepted by the owners. The hirer must ensure that the use of such items is appropriate, including the suitable age/competence of children. Owner will not be liable for any death or personal injury or other damage caused directly or indirectly by the use of such. No responsibility is accepted and no liability or any other loss or damage in connection with the use of such amenities and items is accepted.
This Agreement and any document referred to in this Agreement constitutes the entire agreement, and supersedes any previous agreement, between the parties relating to the subject matter of this Agreement.
A variation of this Agreement is valid only if it is in writing and signed by or on behalf of each party.
The hirer may not assign or transfer or purport to assign or transfer a right or obligation under this Agreement.
This Agreement is governed by, and shall be construed in accordance with, English law and the parties hereby submit to the non-exclusive jurisdiction of the English courts.
